Technical Consumer Products, Inc. (hereinafter referred to as either “TCP”, “we”, “us” or “our”) respects the privacy of every individual who visits this website (the “Site”) and is sensitive to privacy issues on the Internet. We believe it is important that you know how we treat the information we receive on the Internet about you. Therefore, this privacy policy (“Privacy Policy”) outlines the information that we may collect from you and how we may use that information. By visiting and using the Site, you indicate that you have read, agree to and accept the practices described in this Privacy Policy.

Collection, Use and Disclosure of Personally-Identifiable Information
In general, you can visit our Site on the World Wide Web without disclosing any Personally Identifiable Information. Personally Identifiable Information (“PII”) may include, but is not limited to, your name, address, phone number and e-mail address. When you submit personal contact information on a contact form, you may voluntarily submit PII that can be used to contact or identify you and administer your account. If you do not wish to provide us with your PII, please do not submit it to us.

We do not market, sell or rent PII to third parties. Except as provided elsewhere in this policy, TCP will not disclose your PII obtained through the Site to third parties outside of TCP and its service providers, affiliates, vendors and business partners unless TCP has the good faith belief that disclosure is reasonably necessary to: (1) cooperate with law enforcement authorities or comply with legal process served on TCP; (2) protect the property and rights TCP, its affiliates or a third party; (3) protect the safety of the public or any person; (4) to prevent or stop any activity we may consider to be, or to pose a risk of being, illegal, unethical, inappropriate or legally actionable; (5) complete, as permitted by law, a business sale, asset transfer, merger, acquisition or reorganization; or (6) fix or debug problems with the Site servers, software or service.

Collection and Use of Non-Personally Identifiable Information/ Logging and Cookies
In some cases, our web servers may automatically collect certain non-PII about you when you connect or link to the Site. Examples of this type of non-PII include the domain names, I.P. addresses, the type of web browser you are using, and the type of computer operating system you are using. One manner of collecting such information is through cookies, which are small bits of data cached or stored on your computer based on Internet activity. Site users shall not be entitled to any compensation stemming from such aggregated or non-identifying information.

Children
The Site is not directed at children, and we do not knowingly collect any PII from children under thirteen years of age. We encourage parents to instruct their children to use their personal data in a safe and responsible manner while using the Internet. If we discover that a child under the age of thirteen (13) years has provided us with PII, we will use commercially reasonable efforts to delete that child’s PII from our systems.

Other Sites; Security
This Site may contain links to other sites. While we try to link only to sites that share our high standards and respect for privacy, we are not responsible for the content or the privacy practices of other sites. This Privacy Policy applies solely to information collected by this Site. Due to the nature of the internet, while we have put in place physical, electronic, and managerial procedures as required by law and as we deem reasonable to safeguard and help prevent unauthorized access, maintain data security, and correctly use the information we collect online, TCP cannot guarantee the security of any information on or transmitted over the internet. As a result, we make no warranty regarding the security of any information you transmit to us via the Site and you do so at your own risk.

Policy Changes
TCP reserves the right to modify its Privacy Policy at any time. Please review this Privacy Policy periodically so that you will be apprised of any changes. All changes and modifications to the Privacy Policy will be effective as of the date the modified Privacy Policy is posted on the Site. Continued use of the services subsequent to any changes to this Policy means you accept those changes. In the event that we make a material change to our policy we will not use PII in a manner materially different than as described in the Privacy Policy in effect at the time the information was collected, unless there is prior consent.

Consent to Transfer
If you are located in the EU, Argentina, Brazil, Canada, Colombia, Peru, Uruguay, China or elsewhere outside of the United States, please be aware that any information you provide to us will be transferred to and stored in the United States. By using this Site or providing us with your information, you consent to this transfer.

Assignability; Governing Law
We reserve the right to disclose, share, assign and/or otherwise transfer user information, including without limitation PII, in connection with a merger, acquisition, consolidation, the sale of substantially all of our assets, or any other corporate transfer, exchange or restructuring, whatever form it may take. You further agree that this Privacy Policy shall be governed by and construed in accordance with the laws of the State of Ohio and the United States of America. Any dispute under or related to this Privacy Policy shall be brought exclusively in the state or federal courts in Portage County, Ohio, United States of America.

Language Discrepancies
In the event there is a discrepancy or inconsistency between the English language version and any translated version of this Privacy Policy, unless otherwise provided by law, the English version shall prevail and govern.

Your California Privacy Rights
A business subject to California Civil Code section 1798.83 is required to disclose to its California customers, upon request, the identity of any third parties to whom the business has disclosed personal information within the previous calendar year, along with the type of personal information disclosed, for the third parties’ direct marketing purposes.
