Privacy Policy

Technical Consumer Products, Inc. (hereinafter referred to as either “TCP”, “we”, “us” or “our”) respects the privacy of every individual who visits this website (the “Site”) and is sensitive to privacy issues on the Internet. We believe it is important that you know how we treat the information we receive on the Internet about you. Therefore, this privacy policy (“Privacy Policy”) outlines the information that we may collect from you and how we may use that information. By visiting and using the Site, you indicate that you have read, agree to and accept the practices described in this Privacy Policy.

Personally-Identifiable Information and Non-Personally Identifiable Information Collected via the Site

In general, you can visit our Site on the World Wide Web without telling us who you are and without revealing any personally-identifiable information about yourself. Specifically, personally-identifiable information (“PII”) refers to any information that uniquely identifies or can be used to uniquely identify, contact, or locate the person to whom such information pertains. In some cases, our web servers may automatically collect certain non-PII about you when you connect or link to the Site. Examples of this type of non-PII include the domain names, I.P. addresses, the type of web browser you are using, and the type of computer operating system you are using. One manner of collecting such information is through cookies, which are small bits of data cached or stored on your computer based on Internet activity. You may configure your browser to reject cookies but, if you do so, you may not be able to use the full functionality of a Site. We may use cookies, clear GIFs, third-party analytics and other similar technology to measure the number of visits, average time spent on the Site, pages viewed, and other similar information. We use this information to measure the use of the Site and to improve the content of the Site.

There are times, however, when we may collect PII from you, including but not limited to your name, address, telephone number and e-mail address. We will not collect any such PII from you unless you provide it voluntarily. Therefore, if you do not wish to provide us with your PII, please do not submit it to us. When you provide us with PII, we may use that information in the following ways: we may use the PII in connection with legal compliance purposes; as stated in the “Assignability” section below; to respond to your inquiries, process your requests or allow you to access specific account information; in connection with the administration and operation of any sweepstakes, contest or promotion entered into by you; we may store and process the PII to better understand your needs and how we can improve our products and services; we may transfer your PII across country borders within our company (but at all times in compliance with this Privacy Policy and any national privacy requirements associated with such country); and/or we may provide other third parties with aggregate, but not individual, data about visitors to, or users of, our Site.

We may share PII and anonymous information with entities that perform functions on our behalf. These third parties may have access to the information you have provided via the Site, including any PII, only to the extent it is necessary to perform their duties and functions, and subject to this Privacy Policy. We do not market, sell or rent PII to third parties. We may disclose PII for legal compliance purposes and in response to legal process, for example, in response to a court order or a subpoena. We also may disclose PII in response to a law enforcement agency’s request, or where we believe it is necessary to protect the confidentiality and security of our records pertaining to you, to limit our legal liability or to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person or as otherwise required or permitted by law.

Safe Harbor Policies (European Union)

With respect to personal information that we receive from European Union (“EU”) visitors to the Site, TCP abides by the Safe Harbor framework agreed to by the U.S. Department of Commerce and the EU. For additional information regarding safe harbor programs (EU), see the U.S. Dept. of Commerce website. Please click here for our United States – EU Safe Harbor privacy practices specifically.

Children

The Site is not directed at children, and we do not knowingly collect any PII from children under thirteen years of age unless the collection complies with the Children’s Online Privacy Protection Act (“COPPA”). We encourage parents to instruct their children to use their personal data in a safe and responsible manner while using the Internet. If we discover that a child under the age of thirteen (13) years has provided us with PII, we will use commercially reasonable efforts to delete that child’s PII from our systems.

Other Sites; Security

This Site may contain links to other sites. While we try to link only to sites that share our high standards and respect for privacy, except to the extent that such linked third party sites represent an affiliate and/or agent of ours and are using information provided by us solely to perform their duties and functions for us, we are not responsible for the content or the privacy practices of other sites. This Privacy Policy applies solely to information collected by this Site. Due to the nature of the internet, while we have put in place physical, electronic, and managerial procedures as required by law and as we deem reasonable to safeguard and help prevent unauthorized access, maintain data security, and correctly use the information we collect online, TCP cannot guarantee the security of any information on or transmitted over the internet. As a result, we make no warranty regarding the security of any information you transmit to us via the Site and you do so at your own risk.

Policy Changes

TCP reserves the right to modify its Privacy Policy at any time. In the event that we make a material change to our policy we may post a notice of the change on the Site. All changes and modifications to the Privacy Policy will be effective as of the date the modified Privacy Policy is posted on the Site. We will not use PII in a manner materially different than as described in the Privacy Policy in effect at the time the information was collected. You should check our Site frequently to see recent changes. We may also let you know about material changes to our Privacy Policy by posting a notice on the Site.
